1. Acceptance of Terms

By downloading, installing, or using SaliLab ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any of these Terms, you must not use the App.

These Terms constitute the entire agreement between you and SaliLab regarding the use of the App, and supersede any prior agreements on the same subject matter.

2. Description of Service

SaliLab is a clinical management tool for mobile devices (iOS and Android) that allows healthcare professionals to:

  • Record and manage patient clinical data locally and in the cloud.
  • Apply specialized clinical formulas (salivometry, BMI, lab values, and others).
  • Generate clinical reports in PDF format.
  • Share clinical information with other professionals in the network.
  • Obtain AI-assisted clinical analysis (AI Insights feature).
  • Receive reminders and manage appointments through push notifications.

The service includes cloud storage through Supabase and notifications through Google Firebase Cloud Messaging (FCM).

SaliLab is currently provided free of charge. The developer reserves the right to introduce subscription plans or paid features in the future, with at least 30 days' advance notice to users.

The App is distributed through Google Play (Android) and App Store (iOS). By downloading it through these platforms, you also agree to their respective terms of service.

3. Eligibility

To use SaliLab you must:

  • Be at least 18 years old.
  • Be a licensed healthcare professional (physician, dentist, nurse, or other regulated profession) with legal capacity to manage patient clinical data in your jurisdiction.
  • Comply with all applicable data protection and healthcare privacy laws in your country.

By creating an account, you represent and warrant that you meet these requirements. SaliLab reserves the right to suspend accounts that do not meet these criteria.

4. Account Registration

To access the full features of SaliLab you must create an account with a valid email address and a secure password.

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at security@salilab.app if you detect unauthorized access.
  • You must not share your account with other individuals.

5. Acceptable Use

You agree to use SaliLab only for lawful and professional purposes. The following are prohibited:

  • Entering fictitious patient data or false information for testing in a production environment.
  • Using the App to manage patient data without a valid professional relationship with them.
  • Attempting to access other professionals' data without authorization.
  • Reverse engineering, decompiling, or disassembling the App.
  • Using the App for unauthorized commercial purposes, including resale of the service.
  • Sending identifiable patient data to unauthorized third parties.
  • Introducing malicious code or interfering with the operation of the App or its servers.

6. Patient Data & Confidentiality

As a healthcare professional, you are the data controller for your patients' clinical data. You agree to:

  • Obtain appropriate patient consent before entering their data into the App.
  • Comply with applicable data protection laws and professional confidentiality obligations in your jurisdiction.
  • Take responsibility for the content you share with other professionals through the Network feature.
  • Not share identifiable patient data for training AI models or for purposes other than clinical care.

SaliLab acts as the data processor for data stored in the cloud, as described in the Privacy Policy.

By accepting these Terms, the healthcare professional (data controller) and SaliLab (data processor) formalize the following data processing arrangement pursuant to Art. 28 GDPR: (a) SaliLab will process patient data only for the purposes described in the Privacy Policy; (b) SaliLab will implement the technical and organizational security measures described therein; (c) SaliLab will notify the professional without undue delay upon discovering a security breach affecting their patients' data; (d) SaliLab will assist the professional in responding to patients' rights requests; (e) SaliLab will not sub-process patient data with third parties not listed in the Privacy Policy without prior notice.

7. Intellectual Property

SaliLab and all its content — including but not limited to source code, design, logos, implemented clinical formulas, text, and graphics — are the property of the App's developer and are protected by applicable intellectual property laws.

You are granted a personal, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms. This license does not grant you any rights to the source code or underlying algorithms.

The clinical data you enter into the App belongs to you and your patients. SaliLab does not acquire any proprietary rights over that data.

8. AI Insights Feature

The AI Insights feature sends anonymized clinical metrics to AI providers (currently OpenAI or Anthropic) to generate clinical decision-support analysis. You acknowledge that:

  • AI-generated analyses are decision-support tools, not substitutes for professional clinical judgment.
  • SaliLab does not guarantee the accuracy, completeness, or suitability of any generated analysis.
  • You are solely responsible for clinical decisions made based on information from the App.
  • Patient identifying data (name, ID) is not sent to the AI provider.
  • The currently active AI provider can be checked in the App settings. Any change of provider will be communicated in advance.

9. Service Availability

SaliLab offers offline access for core features. Cloud features (synchronization, AI Insights, notifications, professional network) require an internet connection and depend on the availability of third-party services (Supabase, Firebase).

We do not guarantee 100% uptime for cloud services. We reserve the right to perform scheduled maintenance, notifying users in advance whenever possible.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • The suitability of the App for any specific medical purpose.
  • The accuracy of clinical formulas for all possible clinical cases.
  • The absence of errors or interruptions in the service.

Use of SaliLab does not replace medical training, professional clinical judgment, or consultation with specialists.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SaliLab and its developer shall not be liable for:

  • Damages arising from clinical decisions made based on the App's analyses or formulas.
  • Data loss due to hardware failures, connectivity issues, or factors beyond our control.
  • Indirect, incidental, special, or consequential damages.
  • Service interruptions caused by third parties (Supabase, Google, AI providers).

In any event, SaliLab's maximum liability shall not exceed the amount paid by the user in the 12 months preceding the event giving rise to the claim. If the App was used free of charge during that period, the maximum liability is limited to one hundred euros (€100).

12. Termination

You may cancel your account at any time from the App settings or by contacting legal@salilab.app. Upon cancellation:

  • Your cloud data will be retained for 30 days and then permanently deleted.
  • Data stored locally on the device will remain until you uninstall the App.
  • You may request a data export before permanent deletion.

SaliLab may suspend or terminate your account if you breach these Terms, notifying you by email except in cases of serious breach or fraudulent activity.

13. Changes to Terms

We may update these Terms periodically. When we make material changes, we will notify you via an in-app notice or by email at least 15 days before the changes take effect.

Your continued use of the App after the new Terms take effect constitutes acceptance of those Terms.

14. Governing Law, Jurisdiction and General Provisions

These Terms are governed by Venezuelan law. For any disputes arising from these Terms, the parties submit to the competent courts of Venezuela, unless the consumer protection laws of your country mandatorily establish a different forum.

Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Force Majeure: SaliLab shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including third-party infrastructure failures (Supabase, Google Firebase), natural disasters, or telecommunications network outages.

Waiver: SaliLab's failure to exercise any right under these Terms shall not constitute a waiver of that right or limit its future exercise.
